Justice Surya Kant : These are matters which happened after July 1. Singh : After filing the MA. And the threat is continuing. And there is genuine serious risk of life in me going to every place to quash the FIR. #NupurSharma


Justice Surya Kant : To that extent we are correcting, we did not intend that you have to go to all places. #NupurSharma


Singh : I beseech your lordships. The threat is genuine and real now. My rights under Article 21. Your lordships are the protecters of Article 21. #NupurSharma


Justice Surya Kant : Have we understood correctly that you will be willing to go to one place of your choice. Singh : Delhi is the first FIR. Wherever the first FIR, that is the law. J Surya Kant : Will you be willing to go to Delhi HC? Singh : Yes my lords. #NupurSharma


Singh refers to previous judgments : Two things I want to show. The place where first FIR is registered, cases are clubbed. And no coercive steps relief is also allowed. #NupurSharma


Justice Surya Kant : On the same analogy, you want to challenge all FIRs in Delhi. Sharma : All other FIRs should be stayed. The same telecast is the subject matter of all FIRs. #NupurSharma


Singh refers to another order where clubbing of FIRs was allowed - Stay of other FIRs and future FIRs on the same telecast. #NupurSharma


Sharma : One FIR is allowed to proceed and others are stayed. Protective orders are passed. TT Antony principle comes into play.


Justice Surya Kant : Mr.Maninder Singh, our main concern is, you were relegated to alternative remedies. How have you said in the MA that the subsequent incidents are preventing you from availaing from alternate remedies?


Singh : It is physically impossible for me to avail other remedies. Justice Surya Kant : We will evolve a mechanism so that you can effectively enforce alternative remedies.


Bench dictates the order : The original writ petition was filed by the petitioner invoking Art 32 in which the first and foremost prayer reads as follows....Since the above relief for quashing of the FIRs can be effectively granted by High Courts in exercise of.


Bench dictates order : ...this Court, on 01.07.2022, relegated the petitioner to avail the alternative remedies. The petitioner has now filed MA No.1238 pointing out interalia that it has become nearly impossible for her to avial the alternative remedy granted by this court


Order : ..and that there is an imminent necessity by this court to protect her life and liberty as guaranteed under Art 21. In support of her plea, the petitioner has averred in the MA that after the order dated 01.07.2022 various incidents including as (i) one Salman Chisti


Order ...claiming to be of Khadim of Ajmer Dargah has circulated a video calling for killing the petitioner (ii) another person hsa circulated a video threatening to behead the petitioner (iii) some more FIRs have been registered against petitioner.


Order : Kolkata police has issued look out circular due to which she apprehends imminent arrest. During the course of hearing, Shri Maninder Singh has referred to two more instances of serious threat to the life of the petitioner and these instances are reported


Order : In the light of the subsequent events, some of which have been noticed above, the concern of this court is how to ensure that the petitioner is able to avail the alternative remedy as permitted by this Court on July 1


Order : In order to explore this, let notice be issued to the respondents returnable by 10th August. Copies of main writ petiiton be also forwarded along with the notice. Liberty granted for dasti and service through standing counsels.


Order : Meanwhile, as an interim measure, it is directed that no coercive action shall be taken against the petitioner pursuant to the impugned FIRs. Singh mentions future FIRs/complaints too. #NupurSharma
